On December 3, 2018, the Utah State Legislature passed HB 3001, enacting the Utah Medical Cannabis Act. The Act became effective immediately upon Governor Herbert’s signature.
The Act permits Utah residents with qualifying medical conditions to possess, transport, and consume limited quantities of medical cannabis without criminal prosecution.
The Act will affect how employers manage situations under the ADA, FMLA, Utah’s Antidiscrimination laws, drug testing, protected expressive behavior, and more.
